UCC FILINGS ON THE COUNTY LEVEL
UCC is an acronym for the words Uniform Commercial Code and are notices of financing statements. “…the office in which to file a financing statement to perfect the security interest or agricultural lien is: (1) the office designated for the filing or recording of a record of a mortgage on the related real property… “(in the State of South Dakota that office is the County Register of Deeds) “ if the collateral is as-extracted collateral or timber to be cut; or the financing statement is filed as a fixture filing and the collateral is goods that are or are to become fixtures…” (SDCL 57A-9-501) In all other cases, the office of the Secretary of State . FILING UCC’S ON-LINE
IF YOU CHOOSE TO, YOU CAN FILE ANY UCC ELECTRONICALLY ON LINE TO INCLUDE FIXTURE FILINGS THROUGH THE SECRETARY OF STATE’S OFFICE UTILIZING THEIR DAKOTA FAST FILE PROGRAM WHICH IS PROVIDED BY SUBSCRIPTION. IF IT IS A FIXTURE FILING, THEY WILL ELECTRONICALLY TRANSMIT THE FILING TO THE COUNTY FOR RECORDING AGAINST THE REAL ESTATE. LINK TO FILING UCC’S ON LINE.

COUNTY FILING & RECORDING FEES FOR A UCC I & III
The fees for filing/recording a UCC I or UCC 3 at the County Level are as follows:
- One debtor and one Page $25.00 Filing and $30.00 Recording Fee = $55.00
- One debtor and more than one Page $30.00 Filing and $30.00 Recording Fee = $60.00
- More than one debtor add $3.00 on per additional Debtor to either of the above two scenarios that apply.
