Also present was Auditor Kiepke. Chairman Fischer opened the meeting with the Pledge of Allegiance. APPROVE MINUTES Motion by Claggett, second by Weiss to approve the minutes from December 22, 2009 meeting. All members voted aye. Motion carried. OPEN PUBLIC SUPPLEMENTAL BUDGET HEARING At 9:30 a.m., motion by Weitala, second by Weiss to open the public supplemental budget hearing. All members voted aye. Motion carried. SUPPLEMENT JAIL BUDGET As per SDCL 7-21-22, motion by Weiss, second by Claggett to authorize a supplement of $85,763.00 from General Fund Cash line item 10100A1010000 to the Jail Budget line items 10100x4110212 Salary - $50,154.00, and 10100x4220212 Medicine - $35,609.00. All members voted aye. Motion carried. CLOSE SUPPLEMENTAL BUDGET HEARING At 9:55 a.m., motion by Weitala, second by Claggett to close the supplemental budget hearing. All members voted aye. Motion carried. APPROVE RESOLUTION FOR CONTINGENCY TRANSFERS Motion by Claggett, second by Weitala to approve the following resolution for contingency transfers for the 2009 budget year. Resolution #122909-01 Contingency Transfers WHEREAS, SDCL 7-21-32.2 states that no expenditures shall be charged to the line item authorized for by SDCL 7-21-6.1, but such appropriate amount may be transferred, by resolution of the board, to any other appropriation in which insufficient amounts were provided or for items for which no appropriation was provided. When transfers are made from the contingency budget to other appropriations, whose revenue is provided by other than general fund revenues, a transfer of fund balances may be made from the county general fund to such other fund in the amount of the budget transfer. Resolution #122909-02 Energy Conservation Grant WHEREAS, The Davison County Commission has identified the need for the implementation of energy conservation measures; and WHEREAS, Davison County proposes to undertake the following projects: County Courthouse Energy Efficiency Project Highway Shop Energy Efficiency Project Safety Center Energy Efficiency Project; and WHEREAS, Davison County is eligible to apply to the State of South Dakota for Energy Efficiency and Conservation Block Grant (EECBG) assistance for the proposed project(s) as Davison County is included in the latest Census of Governments (2007) as an incorporated municipality or county; and Davison County has a governance structure with an elected official and governing body; and Davison County was not eligible for a direct allocation of EECBG under the ARRA program; and WHEREAS, with the submission of the EECBG application for Davison County assures and certifies that all EECBG program requirements will be fulfilled, THEREFORE, BE IT RESOLVED that the governing body of Davison County duly authorizes the Chairman of the County Commission to sign and submit all necessary paperwork for the EECBG application on behalf of Davison County. A roll call voted was taken as follows: Kiner aye, Weiss aye, Claggett aye, Weitala aye, Fischer aye. Motion carried. Resolution #122909-03 Set Elected Officials Wages WHEREAS, SDCL 7-7-9.1 states that the board of county commissioners shall establish, by resolution, the salary payable to the county treasurer, county auditor, and county register of deeds. The salary payable may not be less than $31,111 based upon the salary schedule which is based upon the most recent decennial federal census of population for counties; and WHEREAS, SDCL 7-7-12 states that the board of county commissioners shall establish, by resolution, the salary payable to the states attorney. The salary payable may not be less than $61,900 based upon the fact that the commissioners have designated the position of states attorney as full time; and WHEREAS, SDCL 7-12-15 states that the board of county commissioners shall establish, by resolution, the salary of the sheriff. The salary payable may not be less than $39,900 based upon the salary schedule which is based upon the most recent decennial federal census of population for counties. The sheriff will also receive an additional 10% added to the $39,900 for managing a full-time jail; and WHEREAS, the Board of county commissioners may not decrease the salary of the county treasurer, county auditor, county register of deeds, county states attorney or county sheriff during consecutive terms of office of the county treasurer, county auditor, county register of deeds, county states attorney or county sheriff; THERFORE BE IT RESOLVED, that elected officials salaries for 2010 shall be set as follows; the treasurer, auditor and register of deeds - $42,750.66, the states attorney - $72,522.78 and the sheriff - $51,555.30. These salaries are not inclusive of longevity pay that may be due some of these officials. RESOLUTION #122909-04 WHEREAS, Davison County does not have enough cash in the Emergency Management Fund for 2009 and it is allowable to do an operating transfer of cash from General Fund to other funds. THEREFORE BE IT RESOLVED that $20,050.00 be moved from General Fund Cash 10100A1010000 to Emergency Management Fund Cash 22600A1010000 for general operating purposes. The other commissioners agreed that the Highway Department had done a good job in clearing the snow. It was also stated that they had done a good job in two emergency situations. Chairman Fischer also thanked Emergency Management Director Montgomery for his efforts in staying in contact with the regions local supervisor in regards to weather related issues.
